Limitation of Liability – BharatFare

This document defines the limits of BharatFare’s legal and financial responsibility. By using the BharatFare platform, the user agrees to all limitations listed below. The purpose of this policy is to ensure full clarity regarding what BharatFare can and cannot be held liable for.
1. General Limitation
- BharatFare is an intermediary platform and does not operate flights.
- BharatFare is not responsible for airline actions, decisions, operational failures, pricing, service quality, or disruptions of any kind.
2. No Liability for Airline Operations
- BharatFare is not liable for:
- Flight delays.
- Flight cancellations.
- Rescheduling or timing changes.
- Operational issues such as overbooking.
- Changes in aircraft or airline policies.
- Loss of baggage, damage to baggage, or mishandled items.
- BharatFare cannot compensate users for airline-related issues.
3. No Liability for User Errors
- BharatFare is not responsible for losses caused by:
- Incorrect name entry.
- Incorrect date of birth.
- Incorrect passport details.
- Wrong travel dates.
- Invalid or expired travel documents.
- Mistakes made during booking.
- All correction fees are the user’s responsibility.
4. No Liability for Visa or Immigration Issues
- BharatFare is not responsible for:
- Visa rejection.
- Immigration denial.
- Boarding denial.
- Failure to meet travel or health requirements.
- Airlines treat these cases as voluntary cancellations or no-show situations.
- Refunds, if any, follow airline fare rules.
5. No Liability for Missed Flights
- BharatFare is not liable for:
- Late arrival at the airport.
- Inability to clear security or immigration on time.
- Missed connections for bookings made under separate tickets.
- Losses from denied boarding.
- Users are responsible for planning their travel timelines.
6. No Liability for Force Majeure Events
- BharatFare is not responsible for disruptions caused by events beyond control, including:
- Weather problems.
- Airport closures.
- Government restrictions.
- Natural disasters.
- Strikes by airline or airport staff.
- Emergencies affecting flights or airports.
- Airline rules apply in all such cases.
7. No Liability for Technical Issues
- BharatFare is not liable for:
- Website downtime.
- Server issues.
- Third-party system outages.
- Slow API responses.
- Payment gateway outages.
- Internet failures on the user’s end.
- These factors are outside BharatFare’s control.
8. No Liability for Pricing Errors
- If a fare changes, increases, or becomes unavailable during checkout, BharatFare is not responsible.
- A booking is confirmed only after successful payment and PNR generation.
9. Limited Liability for Refund Delays
- Refund timelines depend on airline processing.
- BharatFare is not responsible for delays caused by the airline.
- BharatFare processes refunds only after the airline releases funds.
10. No Liability for Third Party Actions
- BharatFare works with airlines, payment gateways, messaging platforms, hosting partners, and API providers.
- BharatFare is not responsible for actions or failures of these third parties.
11. Maximum Liability
- In all cases, BharatFare’s maximum liability is limited to the service fee paid by the user.
- BharatFare will not be responsible for:
- Consequential loss.
- Loss of income.
- Loss of opportunity.
- Emotional distress.
- Additional travel expenses.
- Hotel, food, or transportation costs.
- Any indirect or incidental damages.
12. User Responsibility
- Users must:
- Provide accurate information.
- Review all fare rules before booking.
- Comply with airline requirements.
- Ensure document validity.
- Maintain secure login practices.
- BharatFare is not responsible for losses caused by failure to follow required guidelines.
13. Acceptance of Limitations
- Using the BharatFare platform means the user fully accepts all liability limitations listed in this document.
