Jurisdiction Policy – BharatFare

This Jurisdiction Policy explains which courts and governing laws apply to bookings made through BharatFare. It ensures legal clarity and allocates legal responsibility appropriately. By using the BharatFare platform, the user accepts all jurisdiction terms in this document.
1. Purpose of Jurisdiction Policy
- The purpose of this policy is to establish which region’s laws apply in case of disputes and which courts have the authority to hear legal matters involving BharatFare.
- This prevents confusion and protects BharatFare from inappropriate legal claims.
2. Governing Law for UK Users
- For users who reside in the United Kingdom or make payments through UK-based financial systems, all disputes are governed by UK law.
- The applicable laws include general consumer protection laws, electronic transaction laws, and travel regulations applicable to intermediaries.
3. Governing Law for Indian Users
- For users who reside in India, or who make payments through Indian banks or Indian payment gateways, all disputes fall under Indian law.
- The courts of Delhi NCR will have exclusive jurisdiction over such disputes.
4. BharatFare's Right to Select Jurisdiction
- In cases where the user's location is unclear or where the transaction involves multiple regional elements, BharatFare reserves the right to choose the applicable legal jurisdiction.
- This ensures flexibility and allows BharatFare to avoid being pulled into unfavourable or irrelevant legal territories.
5. No Jurisdiction Outside Declared Regions
- Users agree not to initiate legal action against BharatFare in any jurisdiction outside the UK and India.
- Any attempt to do so will be considered invalid.
- This includes attempts to file claims in the United States, Canada, Europe (outside UK), Australia, or any other region.
6. Travel to or Through Other Countries
- Even if a flight touches or passes through other countries, this does not give those countries legal jurisdiction over BharatFare.
- All operational and refund responsibilities remain with the airline, not BharatFare.
7. Airline Jurisdiction
- Users understand that airlines operate under their own jurisdictions and regulatory systems.
- Airline dispute resolution processes do not transfer to BharatFare.
- BharatFare cannot represent users in airline legal processes.
8. Payment Gateway Jurisdiction
- Payments processed through gateway partners fall under the jurisdiction of those gateways.
- Disputes arising from payment failures, chargebacks, or technical issues must follow the policies of those gateways.
- BharatFare is not responsible for legal outcomes involving third party financial institutions.
9. International Users
- International users outside the UK and India may still use the BharatFare platform, but agree that:
- Any disputes must be handled under UK law or Indian law only.
- They do not have the right to bring BharatFare under their home country’s legal system.
10. Compliance With Local Laws
- Users are responsible for ensuring that using BharatFare does not violate local laws in their own region.
- BharatFare is not liable if a user accesses the platform from a region where travel booking intermediaries are restricted.
11. Limitation of Claims
- All claims against BharatFare must be filed within six months from the date of the event giving rise to the claim.
- Claims submitted after this period will not be accepted.
12. Policy Amendments
- BharatFare may update this Jurisdiction Policy at any time without prior notice.
- Continued platform usage means acceptance of the updated version.
