Agent Agreement – BharatFare
Effective Date: August 31, 2025
This Agent Agreement defines the terms under which individuals or agencies ("Agent") use the BharatFare platform to make bookings on behalf of customers. By registering as an Agent, you agree to all conditions in this Agreement.
1. Purpose of This Agreement
- The purpose of this Agreement is to establish rules for agent onboarding, booking handling, customer management, payment responsibilities, and commission structures.
- This Agreement exists to protect BharatFare from misuse, fraud, or operational risk.
2. Role of BharatFare
- BharatFare provides agents with access to flight search tools, booking systems, and support channels.
- BharatFare does not guarantee:
- Any fixed commission rate.
- Availability of any fare.
- Profitability of agent business.
- Continuous or uninterrupted system access.
3. Agent Responsibilities
- Agents must:
- Provide accurate traveller details.
- Verify passport, name spelling, date of birth, and travel preferences before submitting bookings.
- Inform customers about airline rules, visa requirements, and baggage allowances.
- Handle first-level customer support for their own customers.
- Ensure no fraudulent bookings, misuse of cards, or suspicious activity is conducted.
4. Liability for Incorrect Information
- If the Agent provides incorrect information, the Agent is responsible for penalties, corrections, and fare differences.
- BharatFare is not responsible for losses due to agent mistakes.
5. Commission Structure
- Commission may vary based on route, season, airline, and business volume.
- BharatFare may change commission slabs at any time without prior notice.
- Commission is earned only after successful booking completion and cannot be claimed for cancelled or refunded bookings.
6. Payment Terms
- All payments must be collected from the customer before confirming the booking.
- If the Agent chooses to book first and collect later, the financial risk belongs entirely to the Agent.
- Chargebacks or fraudulent payments will be recovered from the Agent.
7. Fraud, Misuse, and Prohibited Actions
- The following actions will result in immediate account termination:
- Using stolen credit cards.
- Creating fake bookings.
- Attempting to exploit system bugs.
- Using automated tools without permission.
- Violating fare rules intentionally.
8. Responsibility for Customer Communication
- Agents must provide clear communication to customers regarding:
- Refund rules
- Cancellation penalties
- Date change rules
- No show conditions
- Visa and immigration requirements
- Agents are responsible for ensuring customers understand airline rules before booking.
9. Refunds and Cancellations
- Refunds follow airline rules only.
- BharatFare service fees are non-refundable.
- If the Agent misinforms a customer, the Agent bears responsibility for resulting disputes.
10. Account Suspension and Termination
- BharatFare may suspend or terminate an Agent account if:
- Unusual activity is detected.
- Multiple chargebacks occur.
- Customer complaints become excessive.
- Airlines raise objections to the Agent’s booking pattern.
- Terms of this Agreement are violated.
11. Communication and Support
- Agents may contact support through WhatsApp, email, or the agent portal.
- Support response times are not guaranteed.
- During peak periods, delays may occur.
12. Data Protection
- Agents must handle customer data responsibly.
- Customer personal data must not be shared or stored insecurely.
- Agents are responsible for compliance with applicable data protection rules.
13. Limitation of Liability
- BharatFare is not liable for:
- Agent financial losses
- Unavailable fares
- System downtime
- Airline cancellations
- Immigration or visa issues
- Errors caused by the Agent or the customer
- Maximum liability is limited to service fees paid.
14. Amendments to Agreement
- BharatFare may update this Agreement without prior notice.
- Continued use of the agent system means acceptance of the updated terms.
15. Term and Termination
- This Agreement remains active as long as the Agent uses the Platform.
- Both parties reserve the right to terminate cooperation without providing a reason.
